Mr. Schelle is senior lecturer (docent) at Faculty of Law of Masaryk University in Brno
where he has worked since 1977. He specializes on modern history of Czech law, especially
on history of public administration and judiciary. He has published dozens of monographs
and textbooks, studies and articles in scientific journals and conference proceedings in Czech
and abroad (e.g. Russia, Poland, Great Britain and Austria). Mr. Schelle has participated in a
number of domestic and international scientific conferences and symposiums. Next to

assistant of Justice of the Czech Constitutional Court. She has been a member of the Czech
Bar Association since 1992. Next, she has written dozens of monographs and textbooks,
hundreds of studies and articles that were published in the Czech Republic and abroad.

ESUME
A conflict of proprietary rights of owners who are neighbors (immediate and remote) is
usually solved by means of rules that limit enjoyment of proprietary rights. The following
principles apply to relations between neighbors:
1. General Clause
d

way that is not reasonable in certain circumstances) bother other persons or seriously
endanger free enjoyment of their rights. However, there are two exceptions arising out of
this rule:
a)
a ban on bothering others in a way that is not reasonable in certain circumstances
b)
a ban on serious endangerment of free enjoyment of rights
One can find a difference between the bothering and endangering as follows:
endangering applies directly to the free enjoyment of right of an owner, but bothering itself
does not actually prevent such enjoyment. However, it makes it uncomfortable or difficult.
The abovementioned obligation applies to the owners of all kinds of things, i.e. movable
and immovable. There is an exemplary list of cases which are linked to the general clause in
the Civil Code and whereto the limitation of proprietary rights does not apply.

arrangements of his or her land or a building standing on such land without taking sufficient
measures for stiffening of the building or the land. This provision prohibits any activity on

i.e. especially such activities that could invoke a move or collapse of dirt or a building itself
(dugouts, etc.)

4. Undergrowth and Overlaps
An infringement made by means of roots or branches are called undergrowth and
overlaps.
5. An Obligation to Build a Fence (Fencing)
Within the relations between neighbors, the solution of the question which owner is
obliged to build a fence around his or her property might seem problematic. There is no
general rule t in the past, a rule of a right hand was used according to which an owner of a
property was obliged to build a fence on the right side of a land or property; this rule is still
often respected as a custom. Hence the law allows court to make a decision on having
owner of a land to build a fence around his or her property if it is needed and if it is
reasonable for a proper use of the property and buildings standing on it. The aspect of
necessity is fulfilled especially if the fencing provides protection against unpermitted
interfering which cannot be prevented in any other way, e.g. intrusion of bred animal.
6. Entering Land and Buildings
d

eventually neighboring building. This cause is partially eliminated by the Civil Code in a way
that it imposes a duty on owners of neighboring properties to allow their neighbors to enter
their land or buildings standing on such land for necessary time and in the necessary extent
if it is needed for administrating such property. However, these provisions do not apply to
v]vP v]PZ}[ }Ç ]v ]o U XPX µv Z t X /( Z Á
damage caused as a result of entering property of others, the person that has caused such
damage is obliged to compensate that damage. This liability for damages is of an objective
nature, which means that it is to be applied regardless of whether the wrongdoer actually
caused that damage or not. Such wrongdoer cannot be exonerated from that liability.

Z}À]]}v}vZµÇ}oo}Á}Z}v}Áv[roperty cannot be used
for ensuring frequent and periodic access to real estate for the purpose of using it regularly,
e.g. in the situation when proprietary right to a building or a land belongs to different
owners. In these cases, the so-called concept of easements may be used.
