The work examines the interplay of different legal regimes and their application to collision cases, providing a comprehensive analysis of the legal and practical challenges faced in navigating these complex situations.
COLREGs are the International Regulations for Preventing Collisions at Sea 1972, which set rules for navigation, speed, and look-out to avoid accidents.
Liability is distributed based on the degree of fault of each vessel, often resulting in proportions like 50/50, 60/40, or 75/25.
Nautical fault is a legal defense that can protect carriers from liability for cargo damage if the damage resulted from errors in navigation or management of the ship.
Safe speed is a velocity that allows a vessel to take proper action to avoid collision and be stopped within a distance appropriate to the prevailing circumstances.
Consequences include damage to vessels and cargo, insurance claims (P&I and cargo insurance), and potential "General Average" loss distribution.
